Terms & Conditions

These Terms and Conditions govern your use of the Bayu Sentosa website and your enrolment in any of our financial education programmes. By accessing the site or registering for a programme, you agree to these terms. Please read them carefully. If you have questions, contact us at [email protected].

2. Acceptance of Terms

By registering for a programme or submitting an enquiry through this site, you confirm that you are aged 18 or over, have read and understood these terms, and have the legal capacity to enter into this agreement. Use of the site constitutes acceptance of these terms.

3. Nature of Our Services

Bayu Sentosa provides financial education in a group learning format. Our programmes are designed to improve financial literacy and do not constitute financial advice, investment advice, or any regulated financial service under Malaysian law. We do not hold a Capital Markets Services Representative's Licence. Nothing in our programmes should be construed as a recommendation to buy, sell, or hold any specific financial product.

4. Enrolment

Enrolment is confirmed upon receipt of full payment of the programme fee. Places are allocated on a first-paid basis. Enrolment is personal and may not be transferred to another person without our written consent. We reserve the right to decline any enrolment at our discretion, in which case any payment received will be refunded in full.

We reserve the right to cancel or reschedule a programme in the event of insufficient enrolment or circumstances beyond our control. In such cases, participants will be offered a full refund or a transfer to an alternative cohort.

7. Participant Conduct

Participants are expected to conduct themselves with respect toward facilitators and fellow group members. Bayu Sentosa reserves the right to remove from a programme any participant whose conduct is disruptive, offensive, or incompatible with the group learning environment. In such circumstances, no refund will be issued.

Participants must not record sessions by any means without the prior written consent of Bayu Sentosa and all other participants in the relevant session.

8. Intellectual Property

All course materials, written resources, and website content are the intellectual property of Bayu Sentosa or its content licensors. Participants are granted a personal, non-transferable licence to use materials for private study purposes only. Materials may not be reproduced, distributed, sold, or used for any commercial purpose without prior written consent.

9. Confidentiality Within Groups

Participants agree not to disclose personal or financial information shared by other group members outside of the programme context. This obligation applies during and after the programme.

10. Disclaimers

Our programmes are provided on an "as is" basis. While we take care to ensure the accuracy of our educational content, we make no representation that the information provided is complete, current, or suitable for any particular participant's circumstances. Financial decisions remain solely the responsibility of the individual making them.

11. Limitation of Liability

To the fullest extent permitted by Malaysian law, Bayu Sentosa's total liability to any participant in connection with a programme shall not exceed the programme fee paid by that participant. We are not liable for any indirect, consequential, or speculative losses arising from participation in our programmes or use of our site.

12. Indemnification

You agree to indemnify and hold Bayu Sentosa harmless from any claims, costs, or damages arising from your breach of these terms or your conduct during a programme.

13. Termination

Either party may terminate a programme enrolment by written notice. Termination by Bayu Sentosa due to participant misconduct does not entitle the participant to a refund. Our obligations under these terms cease upon termination, except for provisions that expressly survive termination (including Sections 8, 9, 11, and 12).

14. Governing Law and Dispute Resolution

These terms are governed by the laws of Malaysia. Any disputes arising shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to the courts of Malaysia, and both parties submit to the non-exclusive jurisdiction of the Malaysian courts.

15. Changes to These Terms

We may update these terms from time to time. The updated version will be published on this page with a revised effective date. Continued participation in a programme after the effective date constitutes acceptance of the revised terms.
